| Introduction | Information Technology has
revolutionized the way we deal with information in both our personal
life and business operations. Information is being created, modified,
stored, and communicated electronically. Many types of information
that can play a useful role in litigation are no longer printed or
stored in paper, but in electronic form. Lawyers and judges who are
used to work in traditional form of “Document Discovery” now face
the challenge of Electronic Evidence Discovery (“EED”). Lawyers have realised the valuable electronic treasures that are being kept in electronic systems and have focused on electronic data for discovery and production in both civil and criminal cases. EED has become the modern litigator’s weapon. Both lawyers and judges need to acquire the knowledge and skills necessary to take advantage of those information in electronic form. We need to have a good understanding of the technology and associated terminology, and to work well with forensic computer experts where necessary. |
