In the information security sector, we deal with risks everyday. Some of us might engage in a contract where one party is to provide security assurance service to the other party. In case of security failing apart, which party should bear the liability? Surely there could be disputes on the matter. Quite often when the parties cannot negotiate a settlement, you are put in a dilemma whether to put forth the case to expensive court proceeding (and expose the security failure to the public) or bear the loss. |
